Inheritance tax and law

Inheritance (Successierecht) and gift (Schenkingsrecht) taxes are payable by each heir on his respective net inheritance.
Heirs inheriting Aruban property from a nonresident are subject to a special conversion (overgangs) tax. This tax is levied at a flat rate of 8% on the property value.
For heirs inheriting from Aruban residents, inheritance and gift taxes are imposed at progressive rates depending on the degree of relationship between the decedent and the heir:
- Spouse and children: 2% to 6%
- Parents: 3% to 9%
- Siblings: 4% to 12%
- Others: 8% to 24%
The taxable estate is the estate’s market value less debts of the estate and the lump-sum allowances between AWG400 (US$222) and AWG4,000 (US$2,222).
