Inheritance tax and law
Inheritance and gift taxes are payable by each heir on his respective net inheritance.
Heirs inheriting property located in the Netherlands Antilles from a nonresident are subject to a special conversion (overgangsbelasting) tax. This tax is levied at a flat rate of 8% on the property value.
For heirs inheriting from residents of the islands, inheritance and gift taxes are imposed at progressive rates depending on the degree of relationship between the decedent and the heir.
The taxable estate is the estate’s market value less debts of the estate and the lump-sum allowances between ANG400 (US$225) and AWG12,000 (US$6,742).
